Smart Fix London ("Smart Fix") and its affiliates, wholly owned subsidiaries and successors (collectively referred to as "Smart Fix," "us," or "we") provide you with access to and use of our website www.smartfixlondon.com (each the "website" or "site") and to any of its sub-domains and related Smart Fix websites or Smart Fix services (our "Services"). These Terms of Use ("Terms," "Terms of Use," or "Agreement" or "Terms of Use Agreement") govern and apply to your use of and reliance on this Smart Fix website, as maintained by Smart Fix, as well as any service(s) offered through this Smart Fix website. Please read these terms carefully. By accessing the site and/or services, you acknowledge that you have read and understood these Terms of Use and agree to them and to comply with them.

If you do not agree to all these Terms, you may not have access to or use the Smart Fix website or services. This Terms of Use Agreement contains terms and provisions that shall control how claims will be resolved between us. For example, see the following sections below: Disclaimer of Warranties and Limitation of Liability, Limited License, Disclaimer, Indemnity, Unlawful Activity, Void where Prohibited and Governing Law and Dispute Resolution. This Terms of Use Agreement also contains a provision in which we agree to Arbitrate any and all claims between us, which will, with limited exception, require you to submit claims you have against Smart Fix and our agents, if applicable, to binding and final arbitration that is governed and controlled by the Canadian Arbitration Association for consumer-related disputes ("CAA").

If you initiate an Arbitration against Smart Fix, you will only be able to pursue claims individually against Smart Fix and our agents, if applicable. You will not be permitted to pursue claims as a plaintiff, representative, or class member in any class action or proceeding, including representative, arbitration, consolidation, class or multiple-party actions or proceedings. Furthermore, you will only be able to seek relief individually. Most of your relief will be limited to monetary, injunctive, and/or declaratory relief. See the Arbitration terms provided below.

Customer Responsibility to Pick Up Devices, Computers and Other Electronics

Kindly be advised that, due to limited space, Smart Fix kindly requests you to retrieve your mobile device, computer, and other electronic items promptly.

If any electronics left at Smart Fix are not collected within 45 days following the notification that your product has been serviced, Smart Fix reserves the right to deem them abandoned. In such cases, Smart Fix may proceed with the disposal of the electronics in compliance with relevant municipal, provincial, and federal laws. By choosing our services, you agree to release Smart Fix from any liability for potential damage or claims related to abandoned property. This condition is outlined in the signed work order provided to every customer before the initiation of the repair process. The disposal or recycling of such property will be at the sole discretion of Smart Fix, occurring 90 days after notifying the customer that their product has been serviced.

Liquid Damage Diagnostic and Board Cleaning Service

Please acknowledge that due to the inherent nature of liquid damage, a device arriving in a "working" or "partially working" condition with liquid damage may not retain functionality after the diagnostic process. The presence of liquid can lead to corrosion and rust on various components, potentially diminishing the device's performance post disassembly and reassembly.

It is advised that if a device is operational upon arrival, you should back up the data before leaving it for diagnosis. Smart Fix holds no responsibility for data loss or non-functional devices following a diagnostic involving liquid damage.

Keep in mind that the objective of a liquid cleaning service is to restore the motherboard to an operable state. This service excludes non-integrated parts such as physical buttons, batteries, Wi-Fi cards/cables, or any other components.

If the liquid damage motherboard cleaning service successfully addresses all device issues, you, as the customer, will be liable for the liquid damage motherboard cleaning fee as outlined in the work order.

In the event that additional non-integrated components are required for device repair, you will be contacted with a detailed price quote. Opting for the replacement of non-integrated components will waive the liquid damage cleaning fee.

Please be aware that if the motherboard cleaning service fails to fully restore functionality to the device's motherboard (rendering the phone irreparable), no charge will be applied for the motherboard cleaning service.

In-Store Cameras

The in-store cameras are employed for aiding in loss prevention and safeguarding both internal assets and customer belongings while you are present in the store. It's important to note that footage from these in-store cameras is never utilized for marketing purposes without explicit consent. Additionally, the recorded footage is systematically erased every 72 hours to uphold privacy standards.

However, please be aware that, upon request, footage may be released to law enforcement officials at any time. This measure is taken to assist in legal and security matters, ensuring a safe and secure environment for all.

REGISTRATION

The following terms and conditions govern all use of the smartfixlondon.com website (the Site) and the services available on or at the Site (the Service). The Service is owned and operated by Smart Fix London. The Service is offered subject to acceptance without modification of all the terms and conditions contained herein (the Terms of Use) and all other operating rules, policies and procedures that may be published from time to time on the Site by Smart Fix London.

In order to access some features of the Site, you will have to create an account. You must submit a valid email address and select a password and a username or email address during the registration process. You may never use another’s account without permission. When creating your account, you must provide accurate and complete information. Failure to do so will constitute a breach of the Terms of Use, which may result in immediate termination of your account.

You must not:

Select or use as a Smart Fix username a name of another person with the intent to impersonate that person.
Use as a Smart Fix username a name subject to any rights of a person other than you without appropriate authorization or use as a Smart Fix London username a name that is otherwise offensive, vulgar or obscene.
Smart Fix reserves the right to refuse registration of or cancel a Smart Fix London username at its sole discretion.
You are solely responsible for the activity on your account and will be responsible for maintaining the confidentiality of your password.

You may never use another user’s account without such other user’s express permission. You will immediately notify Smart Fix London in writing of any unauthorized use of your account, or other account-related security breach of which you are aware.

The information, content and materials provided on this site are for general informational and educational purposes. Certain sections of this website are intended for particular audiences, including Smart Fix London’s customers, members of the Smart Fix London community and the general public. Your access to and use of the information on this website are subject to this Terms of Use agreement. By accessing and using this website, you accept, without limitation or qualification, the terms of this Agreement.

AUTHORIZED USERS

Access to certain features of our sites may be limited to authorized users (“Authorized Users”) who have registered with us to create a user account (“User Accounts”). Authorized Users may be subject to additional terms specific to the site or the services offered. If registration is required, you agree that all information you provide will be accurate, current and complete, and you will keep such information up to date. You are responsible for maintaining the confidentiality and security of your username and password and are fully responsible for all activities that occur through your User Account. You agree that Smart Fix may collect and use data related to your device, operating system, applications, GEO Location, and IP Address/Location that is gathered periodically to facilitate the distribution of software updates and other communications related to the application (if any). You further agree that Smart Fix may continuously use this data and information to improve the application.

Smart Fix will use reasonable efforts to include accurate and up-to-date information on this site but makes no warranties or representations of any kind as to the accuracy, currency or completeness of the information presented on this Smart Fix website. UNLAWFUL ACTIVITY

We reserve the right to investigate complaints or reported violations of the Terms of Use and to take any action we deem appropriate, including, but not limited to, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary to such persons or entities relating to user profiles, email addresses, usage history, posted materials, IP addresses, GEO Location/IP Location and traffic information. You acknowledge that we will have the right to report to law enforcement authorities any action that may be considered illegal and any reports it receives of such conduct.

When requested, we will cooperate fully with law enforcement agencies in any investigation of alleged illegal activity.

We may also be required to disclose your information in response to a lawful and enforceable request by law enforcement, judicial, or other public authorities or in connection with an enforceable legal obligation. In such instances, we will disclose your Personal Information upon receipt of an enforceable court order, subpoena, or other lawful processes, or where otherwise required by law.

CHILDREN

The site and any service provided are intended for use by adults. By using or accessing our site or service, you represent and warrant that you are 13 years of age or older and can fully enter into and abide by our Terms. Any use of or access to the site or service by anyone under thirteen years of age (13) is not permitted and violates our Terms of Use. We may terminate your User Account and delete any profiles, content or data you may have created or posted if we believe, in our sole discretion, that you are less than 13 years old.

GOVERNING LAW AND DISPUTE RESOLUTION

This Terms of Use Agreement, your use of the Smart Fix website and any services and/or products shall be governed by the laws of Canada and Ontario without regard to its conflicts of laws principles.

Any legal action, dispute, arbitration or other proceeding related to this Smart Fix website, this Terms of Use Agreement, services and/or products shall be governed by the exclusive jurisdiction and venue of and brought exclusively in the federal and state courts of Ontario, Canada unless jurisdiction and venue are mandated elsewhere by law. Thus, as a result, you waive any challenge to personal jurisdiction, venue or forum non-conveniens in any such London courts.

You further agree that this Terms of Use Agreement shall be governed by and construed following the laws of Ontario and Canada, including their conflict laws. Thus, the laws of Ontario, without regard to its choice of law provisions, shall apply to and control any interpretation, construction, performance or enforcement of this Terms of Use Agreement and any Claim, dispute or legal proceeding between us, whether in an arbitration or a Canada court proceeding.

ARBITRATION

For any dispute you have with Smart Fix concerning this Terms of Use Agreement, you agree first to contact us at info@smartfixlondon.com and attempt to resolve the dispute with us informally.

Suppose we are not able to resolve your dispute. In that case, we each AGREE to resolve any claim, dispute, controversy or legal proceeding arising out of or in connection with or relating to this Terms of Use Agreement, your use of the Smart Fix website and any services and/or products, including any breach or alleged breach thereof (collectively, “Claims”), by binding, individual arbitration under the rules of the Canadian Arbitration Association for consumer-related disputes (AAA”).

You and we agree that any Arbitration between us shall be governed and controlled by the Consumer Arbitration Rules, which are posted at https://canadianarbitrationassociation.ca/, and not by any state arbitration law.

Thus, you AGREE that any and all CLAIMS related to your relationship with Smart Fix, including without limitation, disputes related to this Terms of Use Agreement, your use of any Smart Fix services and/or rights of privacy and/or publicity, infringement, or to any products or services sold or distributed by Smart Fix or through Smart Fix shall be controlled, governed and resolved by binding arbitration under the American Arbitration Association’s rules for arbitration of consumer-related disputes, rather than in and by a court, except that you may assert claims in a small claims court sitting in Ontario, Canada if your claims qualify. Notwithstanding, you and Smart Fix now expressly waive the trial by jury.

Arbitration is conducted without a judge or jury, and certain litigation rights that we each may have may be unavailable in arbitration, such as discovery, rights to an appeal and review of an arbitration award, all of which are generally limited in arbitration as compared to litigation.

While an arbitrator, for the most part, has the power to award the same damages and relief as a court on an individual case-case basis, an arbitrator does not have the right or power and is not authorized to award any reliefs, damages, remedies or awards that are inconsistent or in conflict with this Terms of Use Agreement.

Thus, any award by an arbitrator must be consistent with the terms and conditions of this Terms of Use Agreement.

You and Smart Fix agree that you may bring claims only in your name and on your behalf. Thus, we each agree that any arbitration, dispute resolution or legal proceeding between you and Smart Fix shall be conducted only individually, on a case-by-case basis in London, Ontario, if an in-person hearing is requested.

You and Smart Fix further agree that no arbitration, dispute resolution or legal proceeding shall be conducted as a class action, arbitration action, representative action, consolidated action or the like.

Thus, you agree that you have given up any and all right to participate in any type of group action, including representative, arbitration, consolidation, class or multiple-party actions, whether initiated by you or not.

To commence Arbitration under this Terms of Use Agreement and the Consumer Arbitration Rules of the CAA, you must submit a Demand for Arbitration to Smart Fix in writing. The Demand for Arbitration must, amongst other things:

Explain the dispute.
List the names and addresses of the consumer and the business, and, if known, the names of any representatives of the consumer and the company.
Specify the amount of money in dispute, if any.
Identify Fairfax County for the hearing if an in-person hearing is requested.
State what you want.

You must also send one copy of the Demand for Arbitration to the CAA at the same time the Demand for Arbitration is sent to Smart Fix. When sending a Demand for Arbitration to the CAA, you must also send (1) a copy of this Terms of Use Agreement, inclusive of our arbitration agreement, and (2) the correct Arbitration filing fee, which is provided in the Costs of Arbitration section at the end of the Consumer Arbitration Rules at https://canadianarbitrationassociation.ca/.

You must pay the Arbitration filing fee before the AAA considers your Demand for Arbitration properly filed. Please consult Canadian Arbitration Association.

MODIFICATIONS

We reserve the right to change these Terms of Use at any time by updating this posting. Updated versions of these Terms of Use will appear on the site and are effective immediately. We may, but are not required to, notify you of changes to these Terms, so you are responsible for viewing these Terms regularly. Should we significantly change how we collect, process or share your personal information, we will provide a specific notice before such changes are implemented. We will also ask that you acknowledge and accept those changes on the website; however, continued use of the site after any such changes constitutes your consent.

SEVERABILITY

The Terms of Use constitute the entire agreement concerning access to and use of the site. Suppose any provision of these Terms of Use is unlawful, void or unenforceable.
